This page tells you the terms and conditions on which we will supply any product or service listed on our website www.busybrainsactivitypacks.com including subscriptions. Please read these Terms and Conditions carefully and make sure you fully understand that by using or purchasing from our website you agree to be bound by these terms and conditions. We reserve the right, from time to time, to change these Terms and Conditions at our sole discretion. We will notify you of these changes if you choose to subscribe to our mailing list. Your use of the website after changes are made means that you agree to be bound by such changes.

2. SERVICE AGREEMENTS
​
Subject to these Terms and Conditions, Busy Brains Activity Packs grants you a limited, revocable, non-transferrable and non-exclusive license to access and use the Site for your own non-commercial personal use. You may not use the site for the benefit of another business. We reserve the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if we believe that its client conduct violates application law or is harmful to Busy Brains Activity Packs’ interest.

Application laws require that some of the information or communications we send you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically comply with any legal requirement that such communications should be in writing. This condition does not affect your statutory rights.

Contracts for the purchase of products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

We will do our best to maintain our website so that you have constant use, but there will be times when your use may be interrupted. Interruption to the services for reasonable periods for maintenance or causes beyond our control is not a ground for repayment of money you have paid. When we are aware of the likelihood of our site being down, we will place a notice on our website to this effect.

3. YOUR STATUS

Your use of this website and purchase of any products from this website is always subject to these Terms and Conditions. By accessing our website, you agree to our Terms and Conditions. If you do not agree to these Terms and Conditions, you must exit our website immediately.

It is the responsibility of all customers to make sure that their payment, contact, and address information is accurate.
Failure to provide accurate details may result in your order being delayed or sent to the wrong address. In this instance, additional charges may be applied where additional costs are incurred by us.
​
4. FULFILMENT AND DELIVERY
​
Your order will be fulfilled within 3 days of your order being placed unless they are due for dispatch during a period of annual leave. In this instance, you will be notified of the delay via an information banner/pop up on the website explaining that packages will be dispatched and prioritised on our return. Subscription services due for dispatch while we are away will be notified prior to our leave via email.
​
Parcels will still be sent via Royal Mail 2nd Class Delivery unless Express Postage is purchased at time of checkout. Once an item has been dispatched it may be subject to delays. We cannot guarantee delivery on a specific day and will not be held liable for delays outside of our control.
​
Royal Mail try to deliver 2nd Class Post in 2-3 business days. You will not hold us responsible for any delays or non-receipt outside of our reasonable control, which relate to the delivery of orders.
​
Customers are obliged to comply with either Royal Mail’s claim compensation process or our process. Failure to comply with these processes, as amended from time to time, will result in no credit being made in respect of such undelivered packs.
​
You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address. In the case of subscription packages, failure to ensure the correct address details are given may result in some or all your parcels being placed on hold.
​
We will not be held responsible for any incorrect information on your account.
​
Should your order not arrive, please contact Busy Brains Activity Packs. We will investigate the issue with Royal Mail on your behalf if the item has not been delivered by the due date plus 10 working days. A full refund or a replacement will be offered if this is deemed necessary once an investigation has been completed by Royal Mail. This can take up to 30 days.
​
5. PAYMENTS
​
Busy Brains Activity Packs takes payment for goods that you purchase through the website via Wix Payments. We may change our prices at any time.
​
With regards to subscriptions, if you do not wish to accept the new price you may cancel your subscription as set out in the Subscription Terms and Conditions otherwise payments will be at the new price.
​
Busy Brains Activity Packs is not privy to any of your credit/debit card information and no card details are stored on Busy Brains Activity Packs website or its servers.
​
6. RETURNS
​
We ensure all items that are posted to our customers are of the highest standard but if there is ever a need to return an item, we do accept returns for a full refund. Under The Consumer Contract Regulations, your right to cancel begins from the moment you place your order, up to 14 working days after receiving your order. Your right to cancel is unconditional.
​
You can return an item for any reason such as faulty, not as described, not fit for purpose, you have changed your mind and more. If you wish to return an item, please notify us by emailing contact@busybrainsactivitypacks.co.uk including your order number. We will then process your return. You will be refunded the full amount of your order provided the item is returned to us in perfect condition as specified in our returns policy (this policy can be viewed by clicking the link at the bottom of the home page). Return postage must be paid by the customer. Items marked as being reduced for having a defect, damage or any other reason will be exempt from the returns policy.

7. DISCOUNTS
​
Please note that discounts may not be used for ‘sale’ or products that have already been reduced in price.
Any discount code usage for Busy Brains Activity Packs is reserved for new customers only (one code per customer/household) unless otherwise agreed by us.

8. SUBSCRIPTION TERMS AND CONDITIONS
​
We offer three subscriptions: 1st Year, Toddler and Preschool. Subscribing to any of these subscriptions enables users to be charged for and receive the next pack in the series automatically.
​
The 1st Year subscription includes 4 packs (0-3 Months, 3-6 Months, 6-9 Months, and 9-12 Months) dispatched over a 6-month period. The 0-3 Month pack will be dispatched immediately when the subscription is placed. The 3-6 Month pack will be charged for and dispatched 2 months later. The 6-9 Month pack will be charged for and dispatched 2 months after that (4 months after you subscribed) and the 9-12 Month pack will be charged and dispatched 2 months after that (6 months after you first subscribed). This will conclude the 1st Year Subscription. The packs in the 1st Year subscription are charged and sent every 2 months (rather than every 3 months) so that you receive the cards before your child has reached the age specified in the pack. To continue to receive our activity cards after the arrival of the 9-12 months pack you will need to purchase the Toddler subscription package.

The Toddler subscription includes 2 packs (12-18 Months and 18-24 Months) dispatched over a 5-month period. The 12-18 Months pack will be dispatched immediately when the subscription is placed. The 18-24 Months pack will be charged for and dispatched 5 months later. The 18-24 Months pack is charged and sent after 5 months (rather than 6 months) so that you receive the cards before your child has reached 18 months. The arrival of the 18-24 Months pack will conclude the toddler subscription. To continue to receive our activity cards after this you will need to purchase the Preschool subscription package.

The Preschool subscription includes 3 packs (2-3 Years, 3-4 Years, and 4-5 Years) dispatched over a 22-month period. The 2-3 Years pack will be dispatched immediately when the subscription is placed. The 3-4 Years pack will be charged for and dispatched 11 months later. The 4-5 Years pack will be charged and dispatched 11 months after that (22 months after the initial subscription was purchased). The packs in the Preschool subscriptions are charged and sent every 11 months (rather than 12 months) so that you receive the cards before your child has reached the age specified in the next pack. The arrival of the 4-5 Years pack concludes the Preschool subscription package.

PURCHASING A SUBSCRIPTION AND REGISTERING WITH BUSY BRAINS ACTIVITY PACKS
​
If you change your address, it is your responsibility to let us know so that we can update your address details in the relevant section of our website/in your account to ensure that orders are not sent out to the wrong address. You can contact us using the email address contact@busybrainsactivitypacks.co.uk. You should expect to receive a confirmation email when the email has been received and the change has been made.
​
Please ensure that this is done in time to take effect before you move as you will not be refunded for any parcels posted to the wrong location and, should you wish the parcel to be resent another charge will apply.
​
It is also the customer's responsibility to update their payment details as necessary including bank cards. Subscription customers can make changes to their payment details by logging into the site and selecting the My Subscriptions tab.
By purchasing any of our subscription packages you agree to provide accurate, up-to-date contact information of your name and current address.
​
Once we accept your subscription the contract is made. You may not transfer, assign, charge or otherwise dispose of the contract, or any of your rights or obligations arising under it, without our prior written consent.
​
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account and password. You agree to immediately notify us in the event of any unauthorised use of your account or other breach of security.
You acknowledge and agree that we may process your personal data in accordance with the terms of our privacy and cookies policy, which is subject to change from time to time.

You understand and agree that the cards you receive are based on the package option you select at purchase. Your delivery name and address should be entered correctly. You are responsible for providing the correct address for your or any other recipient you are sending a gift to.
​
SUBSCRIPTION RENEWALS
​
If you subscribe to the Service, you agree that you will promptly update your account information with any changes (for example, a change to your billing or shipping address or debit/credit card expiry date). It is the responsibility of all customers to make sure the information in their accounts is accurate. You agree to pay Busy Brains Activity Packs the amount that is specified in the subscription; in accordance with these Terms of Service. You hereby authorise Busy Brains Activity Packs to charge your debit/credit card in advance of the dispatch of your next pack, in accordance with the terms that are applicable to the subscription you purchased, until you cancel your subscription, change your subscription to a different subscription, or your subscription expires.

You understand and accept that you will be charged for the initial pack at the time of accepting the subscription and you agree to your debit/credit card being charged again as specified in the terms of your chosen subscription package. For example, if you have purchased the 1st Year Subscription your credit/debit card will be charged every 2 months for 6 months. The same principal applies for subscriptions of different lengths. Should you not wish for the renewal to take place, you should email as below (see Cancelling a Subscription) as soon as your last pack has been received and before the renewal payment has been taken. You will have 28 days to do this. All payments made are non-refundable. Dispute of any charges must be notified to Busy Brains Activity Packs within thirty-one (31) days of the charge being made. We reserve the right to change the price(s) of our subscription and will give you at least thirty-one (31) days’ notice of any such change. The notice of the price change will be on the website and we will also email it to you. Your continued use of the Subscription Service after the price change becomes effective constitutes your agreement to pay the changed amount.

CANCELLING A SUBSCRIPTION
​
We would hate to see you go, but if you need to cancel any of our subscription packages you must send us an email with at least thirty-one (31) days’ notice. You will need to follow the cancellation procedure and will be given clear instructions when your account has been cancelled and your 31 days’ notice given. You will also receive an email confirming this. Please note that we are unable to accept cancellations by live chat.

You understand and agree that once you have cancelled your subscription you may receive and be charged for one further pack if it is due to be dispatched during the thirty-one (31) days’ notice period.
​

Please use ‘Cancel Subscription’ as the email subject. For security reasons, please provide your name, first line of your address and postcode.
​
If your subscription pack has already been dispatched you will be required to return the order for a refund. Please note that you are responsible for the cost of returning any Busy Brains Activity Packs parcels and for ensuring it reaches us safely.
​
If you wish to cancel a subscription but not return the activity pack you have already received will be liable for the full cost of a one-off pack (£14.99).
​
You agree not to hold us responsible for banking charges incurred due to payments on your account.
​
9. YOUR CONDUCT
​
You are solely responsible for all reviews, blog comments, video, photographs, messages, and any other material that you upload, email, or transmit in any way to the website. You agree that you will not post any content where you do not have the legal right to do so. Nor will you post any content that is defamatory, libellous, pornographic, unlawful, excessively violent, promoting violence, promoting illegal activities, discriminatory based on race, sex, age, religion, disability, or anything else that is generally accepted as being objectionable or that Busy Brains Activity Packs deems as being objectionable. In addition, you agree not to post any content that is likely to harass, upset, embarrass, alarm, or annoy any other person.

10. COPYRIGHT

The contents of Busy Brains Activity Packs and this website are intended for personal use only. You are not authorised to share, copy, photocopy, reproduce, translate, distribute, or publish, in whole or in part, any information, without the prior written consent of Busy Brains Activity Packs, this prohibits copying in both electronic form and hard copy.

13. OUR CONTRACT WITH YOU

Any order that you place may be cancelled by us at any time prior to dispatch. In the event of this happening, no contract for that or those orders, will exist between Busy Brains Activity Packs and you. You will be notified by email of the cancellation and the reason for the cancellation.

14. LIABILITY LIMITATION
​
Busy Brains Activity Packs makes no warranty that the service or products will meet your requirements or expectations. You understand and agree that we will not be liable for any direct, indirect, or consequential damages because of using our website or products. Nor will it be liable for the cost of your procurement of substitute goods for any reason including but not limited to, the non-arrival of an expected order or your inability to access the website due to a service failure.
